NOT GUILTY


In September 2009, Jeremiah P. Connolly and Rachel D. Kiley obtained a defense verdict for Air Serv Corporation in a $1,500,000 subrogation action. An airline passenger fell on the tarmac en route to boarding a plane at O’Hare Airport causing her to sustain fractures to her cervical spine, orbit, clavicle and nose. Her injuries left her unable to care for her husband who had previously suffered a stroke.

The family sued United Airlines, Atlantic Coast Airlines, Air Serv Corporation and Anthony Smith (Air Serv employee). United Airlines and Atlantic Coast Airlines settled with the family for $1,500,000 and sought full reimbursement from Air Serv under theories of negligence and breach of contract. After a week-long trial, the jury found in favor of Air Serv.
